PPPR Act 1988
The PPPR Act 1988 (Protection of Personal & Property Rights Act) applications are necessary when your loved one no longer has the capacity to give their authority to the appropriate Welfare Guardian (Care & Welfare matters) or Property Manager (Property matters).
We will assist you to make an anxious but necessary decision to protect your loved one.
The NZ Courts are very reluctant to interfere in the way a person deals with their own property or care and welfare as this is considered a basic human right. However, if the "person affected" is no longer able to make important life decisions the Court will grant authority to an applicant who is willing and best able to make decisions in the best interest of the person affected.
CARE AND WELFARE - Welfare Guardian
1. As with the EPOA process the Welfare Guardian will speak to the Doctors and make decisions as if they were the person
2. Formal applications are made to the court for the appointment of the Guardian.
PROPERTY - Property Manager
-
As with the EPOA process the Property Manager will deal with the property. They will have an added responsibility as a Trustee who will need to account to the Court, if necessary to any use of the property.
We will assist you to make your application for appointment as Attorney for your loved one.
